The Court of Appeal found that the appellant was not notified of the actual date when the disciplinary proceedings commenced, as there was no evidence that any proceedings took place on the originally notified date of 23rd December 2013. The proceedings instead began on 14th January 2014 without further notice to the appellant. The appointment of Inspector Saidi to represent the appellant in absentia did not satisfy the requirements of fair hearing, as he failed to actively represent the appellant's interests.
