The court held that, pursuant to Section 333(2) of the Criminal Procedure Code, it is fair and just to ensure that the applicant, who had been in custody from the date of arrest to conviction, benefits from the express provisions of the law. The sentence of 15 years imposed on 15th January 2019 should be computed from 4th February 2015, the date of arrest, as the applicant remained in custody throughout the trial. The court found merit in the application and revised the commencement date of the sentence accordingly.
