Ratio Decidendi

The court also noted that the claimant had admitted to receiving service pay, which had already been credited in the judgment. Consequently, the court held that the application for review had merit and allowed it to the extent of reviewing the judgment to exclude the house allowance award. The net award to the claimant was accordingly reduced by the amount of house allowance previously granted, with the rest of the judgment remaining undisturbed.
