The court found that the taxing officer did not err in principle in her approach to instruction fees, as the claimants issued similar instructions and the suit was prosecuted jointly. Rule 62 of the Advocates (Remuneration) Order does not support multiplying instruction fees by the number of claimants where a single suit and similar instructions are involved. However, the court held that getting up fees are payable even where the matter is disposed of by written submissions, as issues for trial were joined by pleadings. The court therefore reviewed the taxing officer's decision to the extent of awarding a third of the instruction fee as getting up fees, but otherwise upheld the taxation....
