Ratio Decidendi

The court found that the Respondents failed to provide evidence of valid reasons for the Claimant's termination and did not follow due process as required by law. There was no proof of poor performance or that the Claimant was warned or subjected to a disciplinary hearing. The employer did not meet the statutory burden under Sections 41, 43, and 45 of the Employment Act, 2007. Consequently, the termination was declared unfair and unjustified. The Claimant was awarded one month’s salary in lieu of notice and eight months’ salary as compensation for unlawful termination, plus costs and interest.
