Ratio Decidendi

The court held that the funds in the law firm’s bank accounts, whether office or client accounts, were under the joint control of both the deceased and the applicant, and therefore form part of the deceased partner’s estate. As such, the accounts are subject to the provisions of the Law of Succession Act, which prohibits any person from taking possession of or dealing with the free property of a deceased person without a grant of representation. The absence of a partnership deed does not alter the deceased’s estate’s interest in the accounts. The applicant must therefore liaise with the deceased’s legal representatives and initiate succession proceedings, such as obtaining a limited grant...
