Ratio Decidendi

The appellate court found that although the Respondent was granted leave to enjoin ZIQRA AUTO DELEARS as a third party, there was no evidence on record that the third party notice was ever served. As a result, ZIQRA AUTO DELEARS was not properly made a party to the proceedings. The trial court therefore erred in apportioning liability to ZIQRA AUTO DELEARS. In the absence of a properly enjoined third party, the Respondent, as the defendant, must bear 100% liability for the accident. The appellate court set aside the apportionment of liability and substituted it with an order holding the Respondent fully liable.
