Ratio Decidendi

The court found that the Respondent failed to provide any evidence of the alleged gross misconduct or to present the Claimant with charges for his response. The contradiction between the termination letter and the positive certificate of service issued by the Respondent's Human Resource Manager undermined the credibility of the Respondent's case. The court held that the Respondent did not have a valid reason for terminating the Claimant's employment and failed to observe procedural fairness as required by law. Consequently, the termination was both substantively and procedurally unfair, entitling the Claimant to compensation and other statutory benefits.
