  1. 1 Whether the sentence imposed for manslaughter upon a plea of guilty was legal and excessive.
  2. 2 Whether the Court of Appeal has jurisdiction to entertain an appeal against sentence following a guilty plea.

Ratio Decidendi

The Court of Appeal held that since the appellant pleaded guilty to manslaughter and was convicted on that plea, the only permissible grounds of appeal were the legality or extent of the sentence. The sentence of ten years' imprisonment imposed by the High Court was within the statutory maximum of life imprisonment for manslaughter and was considered lenient. The Court found no illegality or excessiveness in the sentence and concluded that the appeal, which was based on mitigation, was not within its jurisdiction to entertain. Accordingly, the appeal was dismissed.
