Ratio Decidendi

The court found that the appellant's plea was not unequivocal, as he did not understand the language in which the proceedings were conducted and his mitigation indicated he did not admit the essential elements of the offence. The trial magistrate erred by not entering a plea of not guilty after hearing the appellant's mitigation. The conviction and sentence were therefore set aside. Considering the complainant had forgiven the appellant, the time already served, and the lack of public interest in a retrial, the court declined to order a retrial and ordered the appellant's immediate release unless otherwise lawfully held.
