Miscellaneous Criminal Application / Ruling on Application for Revision of Sentence

  1. 1 Whether the High Court has jurisdiction to revise the applicant's sentence under section 333(2) of the Criminal Procedure Code when an appeal is pending before the Court of Appeal.
  2. 2 Whether the period spent in remand prior to conviction should be factored into the applicant's sentence.

Ratio Decidendi

The High Court lacks jurisdiction to entertain an application for revision of sentence under section 333(2) of the Criminal Procedure Code when the applicant has already filed an appeal to the Court of Appeal. Once an appeal is lodged, the matter is properly before the appellate court, and the High Court, being a court of concurrent jurisdiction, cannot review or revise its own decision. The applicant's recourse lies with the Court of Appeal, where his appeal against conviction and sentence is pending. Accordingly, the application for revision is not merited and must be dismissed.
