The alleged new evidence relating to Succession Cause No 1672 of 2008 was irrelevant to the issues determined in the application of 13th August 2009 and the subsequent ruling of 18th November 2010. The Plaintiff was aware of the orders in the consolidated cases at the time of the earlier hearing and failed to exercise due diligence.
