As such, granting a stay would be futile since there was no subsisting order to stay. The applicants failed to satisfy the two limbs required under Rule 5(2)(b): they did not demonstrate an arguable appeal nor that the appeal would be rendered nugatory if stay was not granted. The Court therefore dismissed the application for stay of execution.
