Ratio Decidendi

The Tribunal found that after the expiry of the written lease on 10th October 2019, the continued occupation by the tenant and the landlord's acceptance of rent created a new, unwritten periodic tenancy. Such a tenancy falls within the definition of a controlled tenancy under section 2(1) of Cap 301. The Tribunal distinguished the situation from one where the landlord refused rent and enforced the expired lease, which would have ousted its jurisdiction. Since the parties continued their landlord-tenant relationship based on conduct and not a written lease, the Tribunal held it had jurisdiction to hear and determine the dispute.
