Procedural Posture

Civil Suit / Post Judgment Application for Correction of Judgment Under Section 99 of the Civil Procedure Act

  1. 1 Whether the court can amend its judgment to correct a clerical error regarding the rate of interest awarded.
  2. 2 Whether section 99 of the Civil Procedure Act empowers the court to correct an accidental slip or omission in its judgment.

Ratio Decidendi

The court found that the reference to interest at 23% per day in the original judgment was a clerical error, as it was clear from the pleadings and the intention of the court that the interest was to be awarded at 23% per annum. Section 99 of the Civil Procedure Act empowers the court to correct such accidental slips or omissions at any time, either on its own motion or on application by a party. The correction does not alter the substance of the judgment but merely ensures that the judgment reflects the true intention of the court. The application was therefore merited, and the judgment was amended to award interest at 23% per annum from 24th December 2015 until payment in full.
