The Court of Appeal held that, following the Supreme Court's binding interpretation, the issuance of Form 38 by the Returning Officer constitutes the final declaration of election results, rendering the officer and IEBC functus officio. Any subsequent cancellation or alteration of the certificate is ultra vires and can only be effected by an election court. The election court erred in holding that the results and certificate were provisional and that IEBC retained power to cancel and reissue Form 38.
