Ratio Decidendi

The court found that although Section 75 of the Civil Procedure Act and Order 43 of the Civil Procedure Rules empower the court appealed to grant leave to appeal, the application for leave must be made expeditiously and within a reasonable time. The applicant failed to seek leave in the court appealed from within 14 days and instead filed the application in the appellate court more than 30 days after the ruling. The court held that this delay was inordinate and unjustified. Consequently, the application for leave to appeal was dismissed with costs to the respondent, as the applicant did not act within the prescribed or reasonable timeframes required by law and judicial discretion.
