Ratio Decidendi

The court held that the existence of an appeal or a valid notice of appeal is a jurisdictional prerequisite for granting an injunction pending appeal under Order 42 Rule 6 of the Civil Procedure Rules. In this case, the applicants' notice of appeal was filed out of time and the application for extension of time was dismissed by the Court of Appeal, rendering the appeal non-existent. Without a valid appeal, the High Court lacks jurisdiction to grant the orders sought. The motion for injunction pending appeal was therefore dismissed, as the court cannot issue orders in a vacuum where the foundational jurisdictional requirement is absent.
