Procedural Posture
Land and Property / Ruling on Interlocutory Applications
Legal Issues
- 1 Whether the application dated 2.12.15 can be traced and considered by the court.
- 2 Whether directions were given for the applications of 29.10.14 and 2.12.15 to be heard together.
Ratio Decidendi
The court declined to write a substantive ruling because the application dated 2.12.15 could not be traced in the court record, and there was no clarity as to when or whether directions were given for the applications of 29.10.14 and 2.12.15 to be heard together. Without the relevant application and clear directions, the court could not proceed to determine the issues before it. The absence of the application and lack of procedural clarity rendered it impossible for the court to deliver a reasoned decision on the merits of the applications.
Court Disposition
No ruling delivered; matter stood over due to missing application and unclear directions.
Orders
- No orders issued due to inability to trace the application and lack of clarity on directions.

I am unable to write a ruling on account of two factors.
1. I am not able to trace the application of 02. 12. 15.
2. It is not clear from the records as to when directions were given for two applications to be dealt with simultaneously (the one of 29. 10. 14 and that of 2. 12. 15).
