The appellant did not adduce evidence to challenge these findings. The only issue for consideration was whether the quantum of damages awarded was inordinately high. The court noted that the appellant had itself proposed the amount awarded by the trial court and found no basis to disturb the award. The appeal was therefore dismissed with costs to the respondent.
