The respondent admitted during cross-examination that she did not know the date of the cane's harvest and did not serve the required notice. Consequently, the appellant could not be held liable for breach of contract. The trial magistrate's finding of breach and the award of damages were therefore set aside, and the appeal was allowed with costs to the appellant.
