Ratio Decidendi

The Court found that the applicant had demonstrated an arguable appeal, particularly on whether the entire 1680 acres should have been transferred to the 1st respondent and whether the applicant’s counterclaim should have been dismissed in its entirety. The Court further held that the appeal would be rendered nugatory if stay was not granted, as the subject property could be transferred to third parties and taken beyond the applicant’s reach, thus destroying the substratum of the appeal. In the interests of justice and to preserve the subject matter, the Court allowed the application for stay of execution pending the hearing and determination of the appeal.
