Ratio Decidendi

The High Court found that it had already determined the applicant's appeal against conviction and sentence, and the applicant had further appealed to the Court of Appeal. By operation of the doctrine of functus officio, the High Court's jurisdiction over the matter was exhausted after the appeal was determined. The applicant's attempt to seek revision of sentence in the same court was therefore improper, as the court could not sit on its own appeal or revisit a matter already concluded. The application was dismissed for lack of merit, and the applicant was advised to await the outcome of his appeal in the Court of Appeal if still pending, or to abide by its result if already concluded.
