Ratio Decidendi

The court found that the applicant, as the decree holder, is entitled to enforce the judgment which declared him the rightful owner of Plot No. 27, Nyakoe Market. The respondents, having been found to be in illegal occupation and having failed to voluntarily vacate or oppose the application, must yield vacant possession. The court ordered that if the respondents do not vacate within seven days, eviction may be carried out by authorized auctioneers with police assistance.
