The court held that although section 79G of the Civil Procedure Act prescribes a 30-day period for filing appeals from subordinate courts, the computation of this period is subject to Order 50 Rule 4 of the Civil Procedure Rules. Order 50 Rule 4 expressly excludes the period between 21st December and 13th January from the computation of time for filing pleadings or taking procedural steps. Applying this rule, the court found that the appeal, filed on 16th January 2018, was within the prescribed time limit when the excluded period is taken into account.
