The court found that the Respondent was in breach of the contract for failing to commence construction of the apartment project five years after the agreement, despite having accepted the Applicant's deposit. The Respondent's failure to follow up on the balance of the deposit and its admission that delays were due to lack of title amounted to a waiver of its right to insist on full payment and precluded it from blaming the Applicant for non-performance.
