The Tribunal found that the Appellant admitted to a portion of the assessed taxes but failed to pay the undisputed amount prior to lodging the appeal, contrary to the mandatory requirements of Section 52(2) of the Tax Procedures Act. The Tribunal held that compliance with this provision is a prerequisite for a valid appeal. As there was no evidence that the undisputed amount was paid or an arrangement entered into with the Commissioner, the Tribunal concluded that the appeal was not competently before it.
