Criminal Appeal / Ruling on Whether a Prima Facie Case Was Established at Close of Prosecution's Case

  1. 1 Whether the prosecution established a prima facie case against the accused to warrant putting him on his defence.
  2. 2 Whether circumstantial evidence adduced was sufficient to link the accused to the murder of the deceased.
  3. 3 Whether inconsistencies in the prosecution's evidence created reasonable doubt as to the accused's guilt.

Ratio Decidendi

The court found that the prosecution's case was based solely on circumstantial evidence, which was incoherent and left reasonable doubt as to who inflicted the fatal injuries on the deceased. There was no direct evidence linking the accused to the murder, and inconsistencies between witness testimony and the autopsy report further undermined the prosecution's case. The court held that suspicion, however strong, cannot substitute for proof beyond reasonable doubt. As a result, no prima facie case was established against the accused to warrant putting him on his defence. The accused was therefore acquitted under Section 306 of the Criminal Procedure Code.
