Ratio Decidendi

The court found that the delay in filing the appeal was only one week and was satisfactorily explained by the applicant as resulting from the insurer's failure to promptly instruct counsel. The court held that the applicant is not seeking a stay of execution, and any prejudice to the respondents can be compensated by costs. The court exercised its discretion under section 79G of the Civil Procedure Act to allow the application for extension of time, subject to the applicant filing and serving the appeal within seven days and paying the 1st respondent thrown away costs within fourteen days. Failure to comply with these conditions would result in the leave being rescinded.
