The court found that while the plaintiff's repeated non-compliance with previous orders was inexcusable and generally would not warrant the court's discretion, there was evidence that the plaintiff had availed the required funds to its advocate. The failure to deposit the funds as ordered was attributed in part to the advocates' inability to operationalize the joint account, a factor not entirely within the plaintiff's control. On this basis, and to do justice, the court exercised its discretion to extend the time for compliance by seven days from the date of the ruling, with strict conditions.
