The High Court lacks jurisdiction to hear appeals relating to work injury claims, as such jurisdiction is vested exclusively in the Employment and Labour Relations Court by virtue of the Employment & Labour Relations Court Act and relevant constitutional provisions. The declaration of unconstitutionality of section 16 of the Work Injury Benefits Act and the clarification of appellate jurisdiction in recent case law mean that any pending or future appeals on work injury matters must be determined by the Employment and Labour Relations Court.
