Ratio Decidendi

The court held that although the application for stay was filed promptly, the plaintiff failed to satisfy the cumulative requirements under Order XLI rule 4(2) of the Civil Procedure Rules, namely, demonstrating substantial loss and offering security for due performance. Furthermore, the court found that after the oral application for stay was dismissed by the previous judge, the court became functus officio and could not entertain a further application for stay on the same matter. The only recourse for the plaintiff was to seek a stay from the Court of Appeal. The application was therefore dismissed with costs.
