The defendant failed to adduce any evidence to support his claim or counterclaim. Upon the expiry of the tenancy and the death of Dr Wanjiru Kihoro, the defendant continued to occupy the property without a valid legal basis and without paying rent, making him a trespasser from 1/1/2008.
