Ratio Decidendi

The court found that the claimant was not given notice or a hearing prior to her dismissal, in violation of section 41 of the Employment Act, 2007. There was no evidence that the claimant used the respondent's property to bake the Mandazi, and the respondent failed to prove payment of terminal dues. The court held the termination was both procedurally and substantively unfair. However, the claimant contributed to her dismissal by bringing Mandazi to the workplace and failing to declare it, warranting a 50% reduction in compensation.
