REPUBLIC OF KENYA IN THE HIGH COURT OF KENYA AT NAKURU CIVIL MISCELLANOEUS E345 OF 2024 SUSAN CHEPKEMOI SAMUTEI ------------------------------------ APPLICANT VERSUS JOEL SANGOGO (ADMINISTRATOR OF THE ESTATE OF THE LATE TAPUTANY KIBETAI) ---------------------------------------------- RESPONDENT JUDGEMENT 1. For the court’s determination is the Applicant’s Notice of Motion dated 12th February 2026 for orders as hereunder;- 1. That Judgement be entered in favour of the Applicant against the Respondent for the sum of Kshs. 86,050 in terms of Certificate of Costs dated 3rd October 2025. Page 1 of 3 2. That pursuant to the Judgement, a Decree be issued for enforcement/execution. 2. The Application is supported by grounds set out on the body thereof as well as affidavit evidence of the Applicant. In a nutshell, the Applicant claims the stated sum on the basis of her Bill of Costs dated 12th February 2025 the Deputy Registrar of this court taxed on 3rd October 2025 in the above stated sum of Kshs. 86,050. 3. Return of service of the Application upon the Respondent is filed but no reply has been made. The Application is therefore deemed as unopposed and hereby allowed as prayed. In any event, there is no conceivable reason for opposing the Application which only seeks to enforce lawfully issued orders. 4. Judgement entered as prayed and Decree shall issue accordingly.
