Procedural Posture

Stay Application / Ruling on Application for Stay of Proceedings Pending Determination of Succession Cause

  1. 1 Whether proceedings in the land dispute should be stayed pending determination of the application to revoke the grant of letters of administration in the succession cause.
  2. 2 Whether the Respondent has proper capacity to sue as administratrix of the deceased's estate.

Ratio Decidendi

The court found that since the Respondent's capacity to sue as administratrix of the deceased's estate is directly challenged in the pending succession cause, and the grant of letters of administration is the foundation of her claim, it is fair and just to stay the current proceedings. Proceeding with the land case before resolving the validity of the grant could render the proceedings nugatory or result in prejudice to the Applicant. The court held that there is no point in continuing with the suit until the issue of entitlement to the letters of administration is determined in the succession cause. Therefore, the application for stay of proceedings was allowed.

Court Disposition

Application for stay of proceedings allowed.
