The purported will by the deceased's wife was of no probative value since she was not the registered owner and could not bequeath property she did not own. Applying section 38 of the Law of Succession Act, the court held that, in the absence of a surviving spouse, the estate should be distributed equally among the deceased's children, who rank in priority over the deceased's brothers.
