Procedural Posture

Civil Cause / Ruling on Application for Dismissal for Want of Prosecution

  1. 1 Whether the suit should be dismissed for want of prosecution due to delay by the plaintiff.
  2. 2 Whether the delay in prosecuting the suit was inordinate or excusable under Order 17 Rule 2 of the Civil Procedure Rules.
  3. 3 Whether the defendant suffered or was likely to suffer prejudice as a result of the delay.

Ratio Decidendi

The court found that although there was a delay of 18 months between the last scheduled hearing and the filing of the application for dismissal, the delay was adequately explained by the plaintiff. The plaintiff had made documented efforts to fix the matter for hearing, as shown by letters received by the defendant's advocates and the court registry. The inability to obtain a hearing date was due to incomplete pretrial compliance, not inaction by the plaintiff. Since the delay was explained and steps had been taken to progress the suit, the threshold for dismissal for want of prosecution was not met. The application was therefore dismissed.

Court Disposition

application dismissed
