The subject matter being ancestral land, the court held that if execution proceeded and the land was disposed of, the applicant would suffer irreparable loss that could not be compensated by damages. The application was filed within a reasonable time—less than one month after judgment—and the applicant had undertaken to comply with any conditions for due performance of the decree.
