Ratio Decidendi

The court found that the cause of action arose on 20th April 2014, and under Section 90 of the Employment Act, the claim should have been filed within three years, by 19th April 2017. The claimant's application for leave to file out of time was made after the limitation period had lapsed. The court relied on the Court of Appeal decision in Divecon vs Samani, which held that the Employment and Labour Relations Court lacks jurisdiction to extend time or grant leave to file a claim out of time for breach of employment contract. Consequently, the court held it had no jurisdiction to grant the orders sought and dismissed both the application and the entire suit as time-barred.
