Requiring the respondent to travel to Makueni would increase her financial burden and disrupt the care of the children. The applicant, being financially better placed and not bearing family responsibilities, can more easily travel to Embu and bring witnesses if necessary. The interests of justice and access to justice are best served by retaining the case in Embu.
