The directors, having been duly served, failed to respond or appear. The court held that it was necessary and justified to summon the Respondent's directors for oral examination on oath regarding the Respondent's means and assets under Order 22 Rule 35 of the Civil Procedure Rules. The court declined at this stage to declare the directors personally liable but left open the possibility should they fail to comply.
