The court found that the respondent, as advocate, received KShs 2,425,263.75 from the applicant for the express purpose of transmitting it to Machakos Ranching Co. Ltd as rent. The respondent failed to do so and retained the funds without justification. There was no advocate-client or contractual relationship between the respondent and Machakos Ranching Co. Ltd, nor any professional undertaking given. The applicant subsequently settled rent directly with the landlord, extinguishing any claim the landlord might have had to the funds. The only legitimate deduction from the sum held by the respondent was the agreed advocate's fees of KShs 460,000.00. The balance belonged to the applicant....
