The High Court lost jurisdiction over disputes relating to ownership, use, and occupation of land upon the promulgation of the 2010 Constitution, which vested such jurisdiction in the Environment and Land Court. Although the suit was properly filed in the High Court in 2000, jurisdiction was lost midstream by operation of law on 27th August 2010. Any further proceedings by the High Court after that date, including the preparation and delivery of judgment, would be in contravention of the Constitution.
