The trial court imposed a fine of Kshs 975,000 on the applicant with a default custodial sentence of two years' imprisonment. Section 28(2) of the Penal Code provides that the maximum default custodial sentence for a fine exceeding Kshs 50,000 is 12 months. The trial court's imposition of a two-year default sentence was therefore unlawful and improper. The applicant had already served eleven months in custody, and the Community Service Officer recommended him as suitable for community service.
