Ratio Decidendi

The court found that the applicant had not filed any defence or substantive pleading to support his application, and therefore had not demonstrated a prima facie case as required for the grant of an interlocutory injunction. Without a prima facie case, the court was not required to consider the other limbs of the Giella test. Furthermore, the orders sought for account and payment of rental income were final in nature and could not be granted at the interlocutory stage without a full hearing. The application was therefore dismissed for lack of merit.
