The court found that the applicant's counsel, Mr. Mwaniki Njuguna, had not complied with the mandatory requirements of Order 9 Rule 9 of the Civil Procedure Rules for change of advocate after judgment. Since the applicant was previously represented by another counsel at the High Court, the incoming advocate was required to either file an application with notice to all parties or obtain a consent between the outgoing and incoming advocates. The failure to comply with this procedural requirement rendered the application fatally defective.
