Ratio Decidendi

The court found that after the confirmation of the grant on 3rd July 2001, the administratrix (the widow) became absolutely entitled to the estate and could lawfully transfer property to any beneficiary. However, upon her death, the Respondent could not lawfully seek rectification of the original grant to substitute herself for the deceased administratrix, as the grant had served its purpose and the estate had already devolved. The proper procedure would have been for the Respondent to petition afresh for letters of administration to the estate of the deceased administratrix, with the consent of all beneficiaries.
