The court found that the counterclaim in the lower court was incurably defective for not being accompanied by a verifying affidavit and for lacking particularization of claims and facts upon which the respondent's case was premised. The respondent failed to produce evidence of allocation of the disputed land, and the alleged allocation date was suspicious as it fell on a Sunday, when public institutions do not operate. The lower court's judgment was therefore void ab initio for upholding a defective counterclaim. The appeal was allowed, the appellant's claim in the subordinate court was upheld, and the respondent's defence and counterclaim were dismissed.
