Ratio Decidendi

The court held that since the main suit had been struck out for being res judicata, it was non-existent and incapable of supporting any further applications or granting substantive reliefs. Section 7 of the Civil Procedure Act bars the reopening of issues already determined as res judicata, and the court cannot revive or entertain applications in a dead suit. The interested party, if aggrieved, must file a fresh suit or counterclaim in the appropriate forum to seek the reliefs sought against the agent. The application was therefore dismissed for being filed in a non-existent suit.
